Estimates become binding only when included within a signed written construction agreement executed by Fidelis Builders and the client.
Material pricing, labor availability, supplier costs, and site conditions may affect final pricing.
3. Scope of Work and Change Orders
Construction services are limited strictly to the scope described in the signed construction agreement.
Any modifications to the scope of work must be documented through written change orders approved by both parties. Additional work performed without written authorization may result in additional charges and schedule adjustments.
4. Client Responsibilities
Clients are responsible for:
Providing accurate project information
Granting timely access to the job site
Making required selections within agreed timelines
Securing homeowner association approvals where applicable
Ensuring property boundary clarity where relevant
Maintaining safe site conditions where client-controlled factors exist
Failure to meet these responsibilities may result in delays, additional costs, or schedule modifications.​
5. Material Availability and Supplier Delays
Construction schedules and pricing are subject to availability of materials and supplier performance.
Fidelis Builders is not responsible for delays caused by:
Material shortages
Shipping disruptions
Manufacturer backorders
Vendor scheduling limitations
Industry-wide supply chain disruptions
Substitutions of comparable materials may be made when necessary and permitted under the construction agreement.
6. Weather and Site Condition Delays
Construction timelines may be affected by weather conditions including but not limited to:
Rain
Wind
Flooding
Extreme temperatures
Storm activity
Unforeseen subsurface conditions
Fidelis Builders shall not be responsible for delays caused by weather events or concealed site conditions that could not reasonably be identified prior to project commencement.
7. Subcontractors and Third-Party Services
Fidelis Builders may engage licensed subcontractors and specialty service providers to perform portions of the work.
While we take reasonable steps to work with qualified professionals, Fidelis Builders is not liable for independent actions of subcontractors beyond obligations defined within applicable written agreements and South Carolina law.
8. Intellectual Property Rights

Total liability, where applicable, shall be limited to the amount paid for services under a written agreement with Fidelis Builders.
Nothing in these Terms limits rights that cannot legally be waived under South Carolina law.

Where disputes relate to construction services, resolution procedures defined within the signed construction agreement shall control.

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the State of South Carolina, without regard to conflict-of-law principles.
