Refund Policy

Fidelis Builders

This Refund Policy outlines the general payment, deposit, cancellation, and refund practices applicable to residential and commercial construction services provided by Fidelis Builders (“Company,” “we,” “our,” or “us”). This policy applies to inquiries and projects initiated through https://fidelisbuilders.net/ unless otherwise governed by a signed written construction agreement.

Because construction services involve scheduling commitments, labor coordination, material procurement, and administrative preparation, refund eligibility varies depending on the timing and status of the project.

1. Relationship to Signed Construction Agreements

If a written construction contract exists between Fidelis Builders and the client, the terms of that signed agreement shall control and supersede this Refund Policy in the event of any conflict.

This policy applies primarily to pre-contract deposits, estimate scheduling commitments, and limited service engagements unless otherwise specified in writing.

2. Deposits and Project Scheduling

Deposits may be required to:

Reserve project scheduling windows
Secure labor availability
Initiate preconstruction planning
Order materials
Coordinate subcontractors
Perform administrative preparation

Deposits are generally non-refundable once project scheduling has been confirmed or material procurement has begun, unless otherwise stated in writing.

3. Cancellation Before Scheduling Confirmation

If a client cancels a requested project before scheduling confirmation and before any material purchases or administrative preparation have occurred, deposits may be eligible for partial or full refund at the discretion of Fidelis Builders.

Administrative processing costs may be deducted where applicable.

4. Cancellation After Scheduling Confirmation

If a client cancels a project after scheduling confirmation, deposits may be retained to cover:

Reserved labor time
Administrative coordination
Project planning costs
Supplier coordination
Opportunity costs associated with blocked scheduling availability

Refund eligibility will be determined based on work completed and expenses incurred at the time of cancellation.

5. Cancellation After Work Has Begun

Once on-site work has commenced or materials have been ordered specifically for a project, deposits and progress payments are generally non-refundable.

Clients remain responsible for payment of:

Labor performed
Materials purchased
Subcontractor services scheduled or completed
Permit application costs where applicable
Restocking fees or supplier penalties if incurred

6. Progress Payments

Construction projects may require progress payments at defined milestones.

Progress payments compensate Fidelis Builders for completed work and are non-refundable once the associated milestone has been reached.

Failure to make scheduled progress payments may result in project suspension, rescheduling delays, or contract enforcement actions consistent with South Carolina law and the governing construction agreement.

7. Custom and Special-Order Materials

Materials that are custom fabricated, special ordered, discontinued, modified for project specifications, or otherwise not returnable to suppliers are non-refundable after purchase.

Examples include but are not limited to:

Custom cabinetry
Specialty lumber orders
Windows and doors built to specification
Tile selections ordered per project
Trim packages
Commercial-grade fixtures
Engineered components

Clients remain responsible for full payment of such materials once ordered.

8. Change Orders and Payment Adjustments

Approved change orders may modify project scope, schedule, and total cost.

Change-order payments are non-refundable once materials are ordered or additional labor has been scheduled or performed.

Any refunds related to unused change-order allowances remain at the discretion of Fidelis Builders unless otherwise specified in writing.

9. Permit and Inspection Costs

Permit fees, inspection charges, engineering services, and regulatory application costs are generally non-refundable once submitted to governing authorities.

Refund eligibility for unused permit allowances depends on municipal or county policies within South Carolina jurisdictions.

10. Delays Outside Company Control

Refunds are not provided for delays caused by circumstances outside Company control, including:

Weather conditions
Material shortages
Supplier delays
Inspection scheduling delays
Permit processing timelines
Utility coordination issues
Site access restrictions
Acts of God or force majeure events

Project schedules may be adjusted accordingly without refund obligation.

11. Client-Supplied Materials

If clients elect to provide materials for a project, Fidelis Builders is not responsible for compatibility issues, installation delays, supplier defects, or resulting schedule impacts.

Refunds are not provided for delays or rework caused by client-supplied materials.

12. Partial Project Completion

If a project is terminated after partial completion, payment obligations remain for:

Labor performed
Materials delivered
Administrative coordination
Subcontractor commitments
Mobilization costs
Project supervision

Any potential refund will be calculated only after deduction of completed work and incurred expenses.

13. Limitation of Liability

To the fullest extent permitted by South Carolina law, Fidelis Builders shall not be liable for indirect, incidental, consequential, or special damages related to cancellations, scheduling adjustments, or material procurement timing.

Total liability, where applicable, shall not exceed the amount paid by the client for services not yet performed.

Nothing in this policy limits rights that cannot legally be waived under South Carolina law.

14. Governing Law

This Refund Policy shall be governed by and interpreted in accordance with the laws of the State of South Carolina.

Any disputes arising under this policy shall be resolved within courts of competent jurisdiction located in South Carolina unless otherwise defined in a signed construction agreement.
